What you are entitled to has NOTHING to do with what the other insurance company decides to offer you. Just go ahead and sue the person for what you are legally entitled to and the insurance company will have to cover their loss. I got a completely unacceptable offer from the other insurance company. I filed suit and a few days I got everything I asked for + rental car reimbursement in one quick phone call. Insurance does not preempt your legal rights when someone has caused you a loss. You are only bound by insurance when claiming against your own coverage.
